Hard questions · Surrogates
Will I have any rights or obligations to the baby?
The short answer
No. In a gestational surrogacy the embryo is not genetically yours, and under Illinois law and your contract the intended parents are the legal parents from birth. You have no obligation to the child and no claim on the child. Many surrogates stay in touch with the families by choice.
