State surrogacy and surrogate pay

Surrogacy in Iowa: is it legal and how does parentage work?

The short answer

Gestational surrogacy is legal in Iowa. Iowa has no comprehensive surrogacy statute, but the Iowa Supreme Court upheld a gestational surrogacy agreement in 2018, and Iowa's criminal code expressly excludes surrogacy arrangements from its prohibition on purchasing a child. Iowa courts grant parentage orders to intended parents; pre-birth orders are available in some counties and post-birth orders in others, and practice is more settled when an intended parent is genetically related. Compensation is permitted. Private Label Surrogacy recruits Iowa surrogates and pays $60,000 first-time base compensation (proposed). Confirm county practice with Iowa counsel.
