Hard questions · Intended parents
What does a pre-birth order do, and will my name be on the birth certificate?
The short answer
In Illinois, intended parents who meet the Gestational Surrogacy Act's requirements are the legal parents at birth and are named on the original birth certificate; the process is an attorney certification, not a court hearing [CONFIRM with counsel]. In other states a pre-birth or post-birth order from a court may be required.
